Terms and Conditions of Use

  1. Basis and Scope of Application

      (SPNM) operates a digital platform on which users, in particular professionals, may access various learning and exchange offerings (e.g. webinars and learning modules) aimed at improving the quality of care for persons with Parkinson’s disease (the Platform). The services offered are exclusively intended for persons who have their domicile or habitual residence in Switzerland.

    2. These Terms and Conditions of Use (TCU) govern the relationship between you (you or the User) and SPNM in connection with the use of the Platform (the contractual relationship).

  2. Registration

    1. In order to access and use the Platform, you must register and create a user account. During registration, you must provide complete and accurate information. Any changes to the information provided during registration must be reported to SPNM without delay.

    2. The user account is personal and non-transferable. You are obliged to keep your access data, in particular your username and password, confidential and to prevent access by third parties. You must notify SPNM immediately if you become aware that third parties have obtained knowledge of your access data, if the access data have been compromised in any way, or if there is any suspicion of misuse of your user account.

    3. SPNM reserves the right to block or delete your user account at any time, temporarily or permanently, without prior notice and at its sole discretion.

  3. Use of the Platform

    1. For the duration of the contractual relationship, SPNM grants you a non-exclusive, non-transferable and non-sublicensable right to access the Platform and to use the content and functionalities provided therein for personal purposes and in accordance with these TCU.

    2. You undertake and warrant that you will:

      1. use the Platform only if, and for as long as, your domicile or habitual residence is located in Switzerland;

      2. not distribute, upload or make accessible on or via the Platform any content that is illegal, obscene, defamatory, threatening or libellous, subject to professional secrecy or any other statutory or contractual confidentiality obligation, or that infringes the personality rights or other rights of third parties;

      3. neither wholly nor partially license (or sublicense), distribute, sell, rent and/or otherwise make available to third parties, modify, reproduce, reverse engineer, decompile, disassemble or otherwise alter the Platform, its components or the content provided on or via it; and

      4. treat all information obtained in the course of using the Platform – in particular information received from other users – as confidential. Without the consent of the persons concerned, you may neither record, store nor disclose such information to third parties.

    3. You acknowledge and agree that SPNM provides no warranty as to the accuracy, timeliness or completeness of the content conveyed via the Platform.

    4. Audio and video conferences are conducted via the Platform using services provided by third-party providers, in particular Zoom Video Communications Inc. (USA). In addition, SPNM uses third-party providers for payment processing, in particular Stripe Payments Europe Limited or Twint AG. The use of such third-party services is subject to the terms and conditions of the respective provider, and SPNM disclaims, to the extent permitted by law, any liability in connection with such services.

    5. SPNM may modify the Platform and its functionalities at any time, add or remove features, and carry out maintenance work and upgrades. SPNM does not undertake or warrant that the Platform will have any specific availability. SPNM may restrict or suspend access to and use of the Platform without prior notice.

    6. SPNM reserves the right to cancel or postpone individual offerings, including at short notice, in particular if speakers are unavailable or other unforeseeable circumstances so require.

  4. Intellectual Property Rights

    1. SPNM or its respective licensors remain the holders of all intellectual property rights relating to the Platform, its components and the content provided on or via it. You acknowledge these intellectual property rights of SPNM and/or its licensors.

    2. By uploading, distributing or making content accessible on or via the Platform, you grant SPNM an irrevocable, transferable, sublicensable, unlimited in time and free-of-charge right to store, edit, translate, distribute, make accessible and publish such content. You also consent to the reproduction of such content on the Platform by SPNM.

  5. Data Protection

    1. SPNM processes users’ personal data in accordance with its data protection declaration, which is available here.

    2. By registering, you declare that you have taken note of the current version of the data protection declaration. SPNM may amend the data protection declaration at any time.

  6. Marketing Communications

    SPNM may inform you by post or by e-mail/electronic newsletters about current and future events and other offerings of SPNM and/or its partners. If you do not wish to receive such marketing communications (any longer), you may notify us at any time in writing at the address specified in Section 1(a) or by e-mail to This email address is being protected from spambots. In addition, you may at any time unsubscribe from our electronic newsletters and promotional e-mails via the unsubscribe link contained in the relevant e-mail or electronic newsletter.

  7. Liability and Indemnification

    1. To the extent permitted by law and unless expressly stated otherwise in these TCU, any liability of SPNM for damages of any kind is excluded. SPNM shall in no event be liable for slight negligence or for the acts or omissions of its auxiliary persons.

    2. You undertake to fully indemnify and hold SPNM harmless, irrespective of fault, against all damages and costs incurred in connection with:

      1. your breach of these TCU or of applicable law in connection with your use of the Platform; or

      2. claims by third parties arising from infringements of intellectual property rights caused by your use of the Platform.

  8. Termination and Its Consequences

    1. The contractual relationship may be terminated at any time with immediate effect, i.e. without retroactive effect, by you or by SPNM. Your notice of termination must be sent in writing to the address specified in Section 1(a) or by e-mail to This email address is being protected from spambots. You need JavaScript enabled to view it.; SPNM will send its notice of termination to your last known postal or e-mail address.

    2. Upon termination of the contractual relationship, you must immediately cease access to and use of the Platform. SPNM reserves the right to technically block access to and use of the Platform, in whole or in part and without prior notice, for example by deleting the user account.

    3. All provisions of these TCU which, by their wording or nature, are intended to survive termination of the contractual relationship shall remain effective thereafter.

  9. Miscellaneous

    1. SPNM is entitled to engage employees, auxiliary persons and/or third parties of its choice for the provision of services.

    2. SPNM reserves the right to amend these TCU at any time and at its sole discretion. Notice of amendments will be given via the internet, by post or by other appropriate means at least 30 days before they enter into force. The amended TCU shall be deemed accepted once you continue to use the Platform after the amendments have entered into force.

    3. Should any provision of these TCU be or become invalid, void and/or unenforceable, the validity of the remaining provisions shall not be affected. The invalid, void and/or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the intended economic purpose of the original provision. The same applies in the event of contractual gaps.

    4. These TCU are governed by Swiss law, to the exclusion of Swiss private international law and, where applicable, the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (CISG).

    5. The courts of the City of Bern shall have exclusive jurisdiction over all disputes arising out of or in connection with these TCU. However, SPNM reserves the right to bring proceedings against you at your place of habitual residence or domicile.

    6. The foregoing choice of law and jurisdiction shall not apply if and to the extent that you are considered a consumer under applicable law and are entitled to mandatorily invoke the application of another law and/or the jurisdiction of another court.
